I ANDREW WILLIAM SHAW of Pembroke House, Pembroke Street, Oxford, Solicitor, hereby MAKE OATH and say as follows:-
1. I am a Solicitor employed by Dallas Brett and I act on behalf of the Defendants in these proceedings. I am duly authorised by the Defendants to swear this Affidavit on their behalf and the facts and matters deposed to by me are within my own knowledge save where otherwise indicated.

12. With reference to paragraphs 9, 10 and 11 of Andrew
Malcolm's (2nd) Affidavit, I am informed by Ivon Asquith and
verily believe that the sequence of events in July 1985 was as follows:
Nicola Bion, an employee of the Defendants, prepared a memorandum dated 16 July 1985 relating to the Plaintiff's work which was addressed "To All Delegates" - this document would have been submitted to the delegates at their next meeting on 23 July 1985. Prior to the delegates meeting, the Plaintiff's work was considered at an editorial meeting on 17 July and was rejected for publication. By a letter dated 18 July, Richard Charkin advised the Plaintiff of the editorial meeting's decision. The Plaintiff's work was not therefore submitted to the delegates meeting on 23 July and no reference is made to this work in the Agenda or the Minutes of that meeting or of any other delegates meeting. There is now produced and shown to me marked "AWS 4" a true copy of the Agenda and Minutes of the delegates meeting of 23 July 1985.

13. I am informed by Ivon Asquith and verily believe that it was not the practice in July 1985 nor is it the practice today for Agendas and Minutes of meeting to be prepared in respect of editorial meetings. Accordingly, no such documents exist or have ever existed in relation to the editorial meeting of 17 July 1985. This is confirmed by Mr Asquith in his second Affidavit sworn on 18 August 1988.
